MANILA, Philippines – The President can still file for judicial redress against Rodrigo Duterte if he's found guilty of the crime, as long as there's no further evidence to disprove the charge against him, justice secretary Vitaliano Aguirre II said on Wednesday, August 20.
"I'm telling you, a judicial proceeding can proceed only if there is corroboration that an accusation is false," Aguirre said at the press conference in which he confirmed the Attorney General's Office (AGO) will hold a hearing on the charges against Duterte.
In a statement released late on Wednesday, Duterte had threatened to file a criminal case against the former "Bolang Tayo" judge.
"I will file charges against him. Even if the prosecution fails. The Attorney General (Agbo) will file charges, which should be against him. This should be for now to the extent he had this right to file that complaint against me," Duterte told reporters Tuesday when the allegations against him were first made public.
As the investigation continues, Aguirre said that the President's allegations "may not be true" to some degree because the accused is an inmate of the Marawi detention center.
The attorney general told reporters that Aguirre's statement comes in response to the Senate Resolution 2, also seeking to investigate Duterte's links with organized crime.
According to the resolution, which was introduced by Liberal Party Senator Manny Pacquiao, "the government is required to hold a formal judicial hearing before it can file charges against the President of the Philippines in the alleged 'bounty' killing of Senator Leila de Lima."
Aguirre said on the House floor that President Rodrigo Duterte's request to investigate the alleged crime was "sad" because of the allegations.
In a separate statement on Wednesday, he said there's still time to file an application if a complaint is substantiated and there is "evidence to support it."
"A judicial proceeding can only be conducted if there is evidence of a commission of crime, and evidence has to be presented to prove that the allegation is false," Aguirre said.
The resolution also stipulates that the Attorney General is also required to establish the location and date of the alleged crime and the date that the alleged crime was committed. (READ: AGO: Imelda is 'bounty' because of Senator de Lima)

Israelis palestinians trade blame for raid death
On Tuesday, Israeli police killed a Palestinian man, Shadi Hamdan al-Batsh, by shooting dead while he was driving along the Ramallah-Nablus road in central Israel.
Al-Batsh, 45, owned at least one construction site in the West Bank and also owned an automobile repair shop in the Old City of Jerusalem, a Palestinian security source said. Al-Batsh is one of nine settlers killed by Israeli security forces since July 1, and the sixth settler to have been killed by an Israeli security force.

Earlier, it was reported that the man was a soldier, a police source told AFP.
Al-Batsh was armed with an automatic weapon, according to Maan news agency, which reported that he had served four years in the Israeli army and had been shot by the army on Monday after attacking soldiers who surrounded a settler building. An Israeli military spokeswoman told AFP that troops fired "under duress" at the alleged attackers.
The raid comes as a wave of deadly Palestinian incursions into Israeli territory, mostly in the southern West Bank, has accelerated this week, after Prime Minister Benjamin Netanyahu accused Palestinian President Mahmoud Abbas of launching repeated incursions into Israel and setting himself up as an occupying power.
